1. Acceptance of Terms

By accessing or using ACE ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

ACE is operated by Code Engine ("we", "us", or "our"), a company registered in the European Union.

2. Description of Service

ACE (Adaptive Context Evolution) is an AI-powered pattern learning platform that helps developers build and maintain contextual knowledge for their projects. The Service includes:

  • Pattern storage and retrieval
  • AI-assisted pattern learning and curation
  • Project and organization management
  • API access for integrations
  • Team collaboration features

3. Account Registration

To use the Service, you must:

  • Be at least 18 years old or have parental consent
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. Subscription and Payment

ACE offers both free and paid subscription plans:

  • Free Plan: Limited features for individual use
  • Basic Plan: Enhanced limits for individuals or small teams
  • Pro Plan: Full features for professionals and teams

Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as described in our Refund Policy.

5. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Upload malicious code or attempt to breach security
  • Interfere with or disrupt the Service
  • Use the Service for competitive intelligence
  • Resell or redistribute access without authorization

6. Intellectual Property

Your Content: You retain ownership of all patterns, code, and content you upload to ACE. By using the Service, you grant us a limited license to process and store your content solely to provide the Service.

Our Service: ACE and its original content, features, and functionality are owned by Code Engine and protected by international copyright, trademark, and other intellectual property laws.

7. AI and Data Processing

ACE uses AI to analyze and curate patterns. By using the Service:

  • You consent to AI processing of your uploaded content
  • We do not train external AI models on your data
  • Pattern analysis is project-scoped and organization-isolated
  • You can delete your data at any time

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may suspend or terminate the Service for maintenance, security reasons, or circumstances beyond our control. We will provide reasonable notice when possible.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACE AND CODE ENGINE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We may terminate or suspend your account immediately, without prior notice, if you:

  • Breach these Terms of Service
  • Violate our Acceptable Use Policy
  • Engage in fraudulent activity
  • Fail to pay subscription fees

Upon termination, your right to use the Service ceases immediately. You may export your data within 30 days of termination.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by the laws of the European Union. Any disputes shall be resolved in the courts of the applicable EU member state. Nothing in these Terms affects your statutory rights as a consumer.
